im not happy with my marriage,im a full time mom, but next quarter im going back to school. i asked my husband a divorce but he dont want to.i dont have job, no car. he said i cant use our car but i can stay in our house if we get divorce. can i get full custody with my kids even if i dont hve job righ now?

Yes, you can get full custody of your kids, even if you do not have a job right now. You may also ask for alimony and child support from your husband. You are also entitled to a division of your marital assets (the home, the car, jewelry, cash, stocks, bonds, insurance policies, and any other real estate or personal property). This means that you will get a certain percentage (usually up to 50%) of everything that is in the marriage. In other words, the court may award you the house and force your husband to leave. Don't let him bully you into thinking that he's doing you any favors by "letting" you stay in the house.
If you cannot afford an attorney, you may still be able to hire one. The attorney can file a request with the court asking that your husband pay your legal fees. Call around!
