Legal Question in Family Law in Georgia
Harassment
My husband and I are seperated, by my choice. I moved out 7 months ago after 4 years of marriage. We are seperated and have filed for divorce, we have one more paper to file before we go before the judge, he is dragging his feet. We have applied for joint custody of our 2 1/2yr twins. I have started dating and he has started harassing me. He has somehow managed to identify the name of the person I am dating, and feels that he has the right to perform background checks in the interest of his children, even though this person has never been around the children. He told me today he knows where he lives, his social security number - he called him by name. i asked how he knew, if he had someone following me, if he broke into my voicemail (as he has done before),he refused to answer. I explained that he was not allowed to do this, that it was an invasion of my privacy and not an issue to the children. He left a message for me a while ago stating ''If I have to go to prison for the rest of my life for the sake of my kids, I will do it''. I percieve that as a threat. He has waited for me to leave church and pulled up right behind me with the kids- what are my rights to privacy, are there any stalking laws? Please help me.

Re: Harassment
You are in a serious situation. You can go the Superior Court where you live and get a restraining order, there should have been one with the papers you filed. If he violates that, then he could face contempt and jail time. However, a restraining order is just a piece of paper. You need to contact local DFCS or Social Services. If you have a local Battered Women group that is the best support and information mechanism. Get some help as soon as possible.
Re: Harassment
It sounds like a potentially serious situation. I would advise calling the proper authorities first and then look into obtaining a protective/restraining order form the courts. I would also document any unusual activity for future use. If you would like to discuss any issues further, please feel free to contact my office. Thank you.
