Legal Question in Family Law in Georgia

Home Mortgage

The divorce court order states taht I have to pay the mortgage payments for 5 years. That time is coming to an end and my ex shows no sign of doing anything. The loan is in my name alone so what rights do I have when that time pertiod ends and she has done nothing. Tille is in her name now and and cannot stop payments as it will effect my credit

Re: Home Mortgage

Consult with a local attorney. It is entirely possible that a petition to modify the decree is in order.

Re: Home Mortgage

Since you haven't said what the paperwork requires her to do (if anything), and she cannot be made to do anything the papers do not require, we cannot answer you.

The person who can answer you is your lawyer from the case and you should call him or her with your concerns.

Re: Home Mortgage

Your divorce decree may have contained some advance planning in anticipation that action would be required with regard to the mortgage at the end of the 5 years. If it did not, then you will probably need the assistance of an attorney to develop a strategy to deal with the situation.
