Legal Question in Family Law in Georgia

My husband, and active duty soldier, has joint shared legal custody with is ex-wife of their 3 year old son. His ex-wife has remarried another soldier who has orders to report to Germany later this year. An agreement can not be made on who shall have him and for how long. My questions are :

1) If my husband does not give his consent for his son to leave the country does that mean she can not take him?

2) If my husband and I do recieve custody for the 3 year commitment that she will be in Germany and he has to deploy will I being a step parent be granted custody or will my step son have to travel at that time to Germany to be with his biological mother?

You as a step parent have no rights.

The rest of your question cannot be answered as the paperwork you have seen and we have not answers it. Assuming the parties used lawyers, the required parenting plan addresses these issues. Read it, and then if there is a dispute,your husband should sit down with a lawyer.
