My husband and I has been actively caring for his 7yr old daughter for a year now. The mother of the child wants to take her from our home. Neither parent has established custody of the child. What are our options in filing for custody..

If he is your husband then he is not hers. If they were divorced the final decree should have addressed the child. if this is the case the final decree states who has custody. if your husband was not awarded primary physical custody then he needs to file a modification action. If they were never married the mother has all legal rights to the child. Your husband would have to legitimate and seek custody. He needs to do that asap. I would advise he do so with an attorney.
