Legal Question in Family Law in Georgia

My husband and I are divorcing. He has agreed to provide me with the same medical insurance that I currently have. He is self employed and he is the policy holder. After the divorce is final, I will get my maiden name back. If it is court ordered that eh provide me with the health insurance, which it will be. Does the health insurance have a right to not continue to give me my benefits is we are no longer married?

Let me first of all stress that you need a lawyer. Do not sign or do anything without counsel.

Regardless of what your divorce papers say, you cannot compel an insurer to provide coverage that does not exist. Many insurance plans drop coverage on the date of a divorce, and many others at the end of that month. A few allow continuation if a decree requires it. For those that don't allow continuation, COBRA coverage is available for a limited time, but it can be costly, and some policies also allow an individual conversion policy. These are things you need to discuss with your lawyer.
