The divorce papers say nothing about insurance, but that does not tell us much. You failed to tell us what the order says about paying for the child's necessary expenses. Certainly, it does, or should, but you left out that necessary part of the story. Presumably, your husband wants to see that his child's medical and dental needs are met?? As far as visitation, what is your question, why is it relevant to the braces issue, and again, what does the order say about visitation? If he is allowed visitation, and has gone 3 years without making sure he gets it, it is most likely HIS fault.

You've left out information needed to answer you, but since you're in bankruptcy (which means you presumably have a lawyer) and her ability to sue is affected for the moment by that, consult with your bankruptcy lawyer.
