Legal Question in Family Law in Georgia

Hello, My husband and I live in Atlanta, GA. My husband pays child support and the order is from New York. We have a problem now and we need help. My husband pays child support every month, which is coming out of his pay check every 2 weeks. My husband has comply with all of the regulations with child support. Now we have a bg problem. the child support place an order to withdraw money from our bank account without any notice. They withdraw over $2000.00 from account, and now we are negative more than $2000.00. First, we didnt have that type of money in our account. The bank wont help us, child support wont cancel the order and placing that money back. Im a CANCER patient taking chemo and radiation treatment, the little money we had was for my medicines and doctors. We dont know what to do!. We need help or suggestions!. Child support will continue to withdra money from the account, even if theres money or not. Because of this we have no funds at all, the bank wont close the account until the money is pay back. Please can someone tell us what is our rights!. Why is child support can go in someones account and take money out and why the bank will let this happen?

The only way that the money can be withdrawn directly from your account is with a Court order allowing the garnishment. It likely means that your husband has NOT been paying child support. I strongly recommend that you hire a Georgia family law lawyer to explain your rights and options based on the specifics of your case.

I agree with Mr. Cook, except, since the order is from New York, you may need a lawyer there.
