Legal Question in Family Law in Georgia
My husband and I have not lived under the same roof for nearly 5yrs now. There is no divorce decree nor any separation agreement. We have a son who will be 15 in Sept. 2010 but there is no child custody agreeement in place. We have pretty much let our son determine if he wants to stay with me or with his father instead of forcing him into a location he does not want. I currently live in Clayton County and the school system is horrible. We have some family friends that live in a different county and are willing to allow my son to stay with them and go to school. My son really wants to do this. He is close to these friends, as well as, their son. However, my estranged husband says he will not sign over guardianship to our friends so that our son could go to a better school. He demands that our son, no matter what our son wants or if going to a better school is in our son's best interest or not, live with either me or him and go to this school which is one of the most gang ridden schools in the county. Do I really need his ok to sign over guardianship to our friends since there is nothing written or am I required by law to have his signature?

You need his okay, or a judge's. More importantly you need a lawyer.
