Legal Question in Family Law in Georgia

My husband and I married this past June. We have been raising my son together since his birth in June 2006, though my husband is not his legal father. My son's legal father pays child support set up through GA and VA. Though lately he has been paying late and recently he paid less than half! My husband has decided he would like to legally adopt my son and change his last name from my maiden name to his (and my) last name. Because we have pondered this before, I know that my son's biological father is willing to sign away his paternity rights, as I have directly asked him before.

What are the steps that I must take to change my son's legal father as well as his last name?
