Legal Question in Family Law in Georgia

My husband & I got married while I was pregnant with out daugher, however, he has not been around since she was born. She is almost 2 & he has seen her 4 times. I've been trying to divorce him but he refused to sign the papers. He paid child support because the army made him, but now he is in jail for deserting the army, so he hasn't paid child support in 2 months. How do I go about divorcing him while he's in prison? I want to make sure I get custody of our daughter, because he just recently started saying that he wants her 50/50, but she doesn't even know who he is.

I suggest you hire an attorney. If you cannot afford one, you will need to file the complaint for divorce and serve him in prison. He doesn't have to sign papers so am not sure why you simply did not file and have him served prior to now.
