Legal Question in Family Law in Georgia

My husband and I prepared our own separation agreement 5 yrs ago in march. We had it signed and notarized. I moved to ga and he remained in va. He stopped paying, I am have been unemployed and have not been able to move foward with the divorce. His total income is over100K. The agreement was never filed anywhere is it still enforceable. What recourse do I have. I consulted an attorney in va in 2004 but ran out of money because we could not reach an agreement. He is now filing uncontested and I don't agree so he has stopped everything.

You s crewe3d up badly 5 years ago and your lack of understanding of things now means you have screwed up again.

Forgetting whether the contents are even well-writen, since you never filed the agreement anywhere, you have no court approval and it may be worthless.

Second, your case is NOT uncontested. To "file uncontested" you and he have to file a signed agreement.

When you are separating or divorcing, you NEED a lawyer. It will probably cost you far more to fix the mess you created with an unfiled 5 year old agreement than it would have cost to do things right, but it will cost you even more not to get counsel ASAP.
