Legal Question in Family Law in Georgia
My husband and I have been together for three years now. We both have children from our previous marriages (2) to be exact, and one child together, We struggle finacially due to the fact that he pays $600 a month in child support, off of his income alone, there is no way to support our large family finacially. I am a nurse, and I am stuck paying all of our house hold bills. She calls all the time for extra money; soccer fees, church funtions, gymnastics, and so on. She doesnt work. But we are now in a horrible predicament, those divorce papers were based on his old job and its overtime. He has had another job now, ever since he moved 2 hrs away to escape her psycho ways. But he is now facing physical disability, due to a work injury. If this happens, and he loses his job based on his medical evaluation, can we have the divorce papers re evaluated, and with the fact that she doesnt work, what are our chances of actually succeeding to have the CS reduced, along with everything else she has threw into the agreement?? Please help!

He should have filed a petition to modify child support when his income decreased from his first job change. He should retain an attorney to file a modification based upon the decline in income. Also, if the child you have with him was born after the divorce, the addition child will also be a factor on his child support obligation.

He should have retained counsel to seek modification when his income dropped. He still may be able to now. He needs counsel to do it properly. Feel free to call me with details.
