Legal Question in Family Law in Georgia
husband's ex-wife wants him to pay half of medical bills before ins
In my husbands divorce papers is states that ex-wife should keep ins on their minor child at her sole expense (which is only apprx $80. per month) he has tried to keep up to date on medical bills but she keeps insisting he has to pay half of child medical bills before any insurance reimbursements. The papers say he is responsible for half of all medical bills, dental, etc. She claims because it doesn't say ''after ins''so he has to pay half of medical bills before ins. But he says also that it does't say ''before ins'' either. What is the norm for this situation? As he sees it if he has to pay half before ins and her premium is of $80. per month then she will make a profit off the child's medical bills. Pleas help. Thank you!

The final decree will govern. If the decree states that the father should pay half of all expenses before or after insurance then that's what he has to do or risk contempt. He can seek to modify this provision if that is what it states. The norm in this type of arrangement is to pay half of those expenses not covered by insurance. Take a closer look at the final decree.

You should demand documentation. If she doesn't give it to you voluntarotly, take her back to court and subpoena the records.
