Legal Question in Family Law in Georgia
My husband's son doesn't live with his mother anymore and he just turned 18 this month. Does he have to wait to stop the child support until he graduates high school next May or can he have it stopped now. And we found out he hasn't lived with his mother for the last three years but they were still taking child support out of his check and she was getting it. Wanted to know can any of that money be put towards his arrears he has to pay or can we get it back. Or we just lost out on that.

The answer depends on the exact wording of the support paperwork, which must be followed.
Retain counsel to try to modify support and raise the fact that husband's son has not lived with his mother (husband's ex-wife) for three years but allegedly kept child support payments for herself - Judge may require her to pay back all or part of it to your husband's son (now that he is 18) and/or allow for direct payments to your husband's son for any and all future payments
