Incompetence

My father is a drug addict, about to go to jail or re-hab. My mother and I think he is losing his mind. How do we go about declaring him incompetent or insane, especially if he is not willing to undergo tests?

You need to have someone appointed as his guardian. You do this through the probate court in the county of his residence. You should consult with a local attorney.
