Legal Question in Family Law in Georgia

inherited home

My husband of 30 yrs. left me 2 weeks ago. We own a home, RV & cars together and he owns the house across the st. from an inheritance. It has been for sale for 3 months. there's no legal separation in GA and I do not wish to file for divorce yet. What can I do to make sure he does not sell the inherited house and run with the money? We were going to get out of debt and put some aside for retirement (before he left).

Re: inherited home

You can file for "Separate Maintenance". This is almost identical to filing for divorce, except that you are not asking for a divorce. Consult with a local attorney.

Re: inherited home

You need to retain an attorney as soon as possible and file for divorce. Then you can get a temporary order to preserve the assets. It's apparent you do not have an understanding of marital property because inherited property is normally deemed separate property. He may be entitled to all the property from the house, however, it all depends on the circumstances and facts. If you've been married 30 years you may be entitled to alimony. Call an attorney immediately.

Re: inherited home

Unless he deeds you some or all of the home, he can do as he pleases without telling you.
