Legal Question in Family Law in Georgia
Instant messenger laws
My estranged husband has retrieved some instant messenger conversations that I had with my current live-in boyfriend. I was living with my husband at the time of these x-rated conversations - cybersex, essentially. Can my husband use these copies as evidence against me in our divorce or are they not admissable in court? How could he prove who wrote these words? Couldn't I contend HE wrote them just to use them against me?

Re: Instant messenger laws
This is a complicated and evolving area of the law. I think your husband could subpoena your boyfriend's cell phone records to prove the messages came from him. However, in this day and time, whether a judge would even consider these important (compare to love letters) is anyone's guess. You should consult with a local attorney and not hold anything back.
