Legal Question in Family Law in Georgia

international divorce

breadwinner in family is female, U.S. citizen; married to Australian male and adulterer, all living in Auckland, NZ. New Zealand law does not recognize husband's adultery as a factor in divorce and wants to award him permanent alimony and partial child support. (he has stayed home to care for the children past 4 years, but not doing a very good job of it) He has been mentally abusive - New Zealand is not recognizing mental abuse as a factor - only physical abuse. Will not leave the house. If female breadwinner takes children and moves to Georgia, can divorce be settled under Georgia law more equitably if she established residencey (one year). What are her legal options?

Georgia would not have jurisdiction without the father's waiver of jurisdiction. Jurisdiction in a divorce action is proper where the defendant is. If the father's whereabouts are unknown, then there may be other options. Feel free to contact my office for further consultation on the matter.
