Thank you for your service.

The fact that you are on his birth certificate does not give you any legal rights to the child. You state that you were "legitimized at the hospital in which he was born". To become "legitimized", you must file documents with the court and go through a legal process --- did you do that? For the purposes of this question, I will assume so since you are paying child support. You will simply need to file a petition for custody in the county in Georgia which the mother and child live. The Court will make a custody determination based on what's "in the best interest of the child." Of course, your chances of success are greatly improved by hiring a Georgia family law attorney to represent you and explain your options/rights.

Best of luck.*******The above is for informational purposes and does not create an attorney-client privilege.*******
