last name issues

is an ex wife allowed to use my name for her new child? we have been divorced and she has been using the name for the sake of our two children. but now she has had a child with someone else and still gave it my last name is this legal?

I have never researched this issue because in 30 years of practicing law it has never come up. Consult with a local attorney.
