Legal Question in Family Law in Georgia

joint checking account

My ex and I just divorced about 3 months ago. We opened a joint checking account that still hasnt been closed. She recently just took 6000 dollars out of the account and transfered it into her account. Was this legal? Is it really all on me because we didnt take the steps to close all the accounts? Can i sue for half of the money she took? Thanks

Surely your lawyer told you to close those accounts. And certainly he addressed it in the papers. If you ignored his counsel twice, it's probably your loss. Check with him since he's read your papers and we haven't.

It was "legal" for her to take the money (didn't break any laws) but unless your divorce papers say otherwise, you are entitled to 1/2 of it. Now, you will have to demand the $$ (in writing) and then take her to small claims court.

I admit that I am surprised that this account was left open, especially for 3 months after the divorce. Quite an oversight.
