Joint Custody rights

My child is in my care now and advised me of possible abuse where he lives. I have joint legal custody and due to return him. Can I refuse to return him to that environment because i fear his safety? I have contacted child welfare where he lives.

If by "refuse" you mean to initiate legal action in the state where the child resides, to protect the child, yes - you could refuse.

If you mean just not take the child back and violate the present court order, that would not do you any good. Find a lawyer and protect the child. Good Luck.

I agree with the previous comments. While I am not licensed in Texas, in Georgia, if the final judgment in your divorce says something and you do the opposite, that is almost asking for trouble. Seek out an attorney to practice in the appropriate forum and comply with the court order.
