keeping my child in TX

Requesting a reply from an attorney whom practices Family Law in Georgia. My ex-girlfriend and I have a mutual agreement to share our three and half year old boy half of each year two months at a time. ''No court order or anything in writting'' I've wanted to keep him here with me to get him an early start in his education and I can provide a better life and better living conditions for him. I am currently married and have another child whom is seventeen months young. I live in a three bedroom home in a very nice deed restricted neighborhood in a nice and safe part of Houston. She lives in a one bedroom motel room with her boyfriend and other child, and her mom and moms boyfriend.

Both boyfriend are illegaly living in the country. There is alot more to this situation but I'll ask my question. In TX it is not a crime ''kidknapping'' for a parent to take a child from there home. I don't want to continue this mutual agreement, I want to keep him here in TX and start his education. If i don't take him back or if I don't let her take him back. Is it considered a crime ''kidknapping'' in Georgia?

This is your ex girlfriend, so I assume you were never married. There is no court order, so I assume that you have not filed a paternity suit. That probably means that at this time you have no legal rights. The answer is that this would probably be seen as kidnapping. If you want rights you need to go to court and request them. I think it would be a VERY good idea to hire an attorney. Good luck.
