My kids want to live with me full time!

My ex-husband and I have joint physical custody of our two boys.Ours boys don't want to go to their days every other week anymore. They want this changed to every other weekend. Their dad doesn't spend time with them they stay with his parents. Our divorce papers state that if he needs a sitter he must call me first which he very seldom does when he needs one. This was what he wanted in the divorce papers. His lawyer wrote the divorce papers.I do call him for a sitter but he won't call me back, or tells me no.His parents have been in Alaska for 3 or 4 months and my boys have not been over there but a very few times. Their dad had no problem with them not coming over. Now his parents are back and they are know for locking their door so I can't get my kids if their dad is not at home.I want my kids to be happy. what can I do?

Visitation problems

Based on the information which you have given it would be possible for you to seeek a permenant change in either the custody award (making you the sole legal custodian) and/or the court ordered visitation. Such a request is fairly routine. Depending on the age of the children, the Court may also consider the desires of the children.

How old are the boys?

The court can modify your visitation provisions at any time that it is in the best interest of the children to do so. The boys may ave some legitimate input in that. in Ga if they are 14 they may chosse who they lve with. realistically, this inslcuded who and when they visit.
