Legal Question in Family Law in Georgia
I was laid off and was unemployed for almost a year. I got behind on my child support payments. I am back working now but am making considerably less. My ex spouse has filed a case against me with child support services and retained a lawyer. What are my rights?

I recommend that you hire a Georgia family law attorney pronto! You can be held in contempt of court for not making child support payments and thrown in jail. Not having a job is no excuse for failure to pay child support -- the court will calculate what you "could make" in lieu of a job. As such, you are still on the hook for the past due payments. With regard to the payments moving forward, I recommend that you speak with your attorney about petitioning the court for a modification of the child support order, based on material change of circumstance (new job, less money).

You can go to jail or have your wages garnisheed. It would be a very good idea to see a lawyer both to respond and possibly modify the order.
