Legal Question in Family Law in Georgia

Hello. I need help with how to go about leaving my husband with my child. He goes through phases of drinking, and when he drinks, he spends all of our money for bills, rent and baby formula/food. He once forcefully threw down the car seat with her in it when I went to pick him up and he was drunk. We do not emotionally connect anymore, and he threatens to keep our daughter (even though I know he isn't fit for the job, he can't stand being with her for a whole day.). We have had to leave for the night a couple times so he can sleep it off. I feared for my childs safety a couple times. I do not have a job because I myself just got out of the military, and my family is supportive of whatever decision I make. I have a gi bill that would pay for rent and other expenses while I finish out school (which would only take a year because I have a lot of college credits). My mother has another house that she would let us live in, and she would be her full time day care provider while I go to school a couple hours a day. Money is not a problem. My husband is. It is a completely unhappy relationship. If he gets like it again, I am almost sure I will drive back to Minnesota with my daughter in the car with me. My mother said to check the laws first. Please help. I need advice. I am scared for the next out burst.

You need to retain a lawyer immediately. That is step one in these situations. Until you do that, you'll remain at his mercy.

At the same time, be prepared to move.

I am not a Georgia attorney, so I cannot offer legal advice, but if he gets out of control and you are concerned for your safety, there are safe houses for abused women that you can find online to help you. They will get you free legal advice and help you to get somewhere safe. I have been in your situation, so if you need help, please call and I can direct you to someone who can help you stay safe.

File for a TRO Family Violence Act (its free at any superior court) and tell Judge you have to leave GA and want to keep your whereabouts secret (that should work until you hire a lawyer wherever you wind up)

God Bless
