Leaving state before the divoice or custody is settled?

Hi i have a 1 year old son, my husband and i just recently separed and i am wanting a devoice, however I need to move back to New Jersey with my family or I won't make it. Is it leagal for me to leave state or do I have to wait? i have not a clue what to do but can;t make here in Georgia any more.

If you want to file in GA, you must do it while you are still a resident. Then, you can move. However, I would suggest that you consult with a local attorney because your husband may request what is known at the "standing order" or "mutual restraining order" which typically prevents either party from removing the child from GA.
