The court decides custody.

However, when the child reaches 14, (s)he will be heard and considered by the court. The child's desires will be considered a material change in circumstances.

When the child is between 11, but has not reached 14, the judge will consider the desires and education needs of the child in determining whilch parent has custody. However, the child's desires are not controlling.
