legal custody change

My ex is wanting change legal custody my our 14 yr old son so he will npt have to pay child support any more. He turned 14 in august and is now spending half he's time with both of us. Would a judge spilt legal custody now?

A child who is 14 years of age may elect which parent he or she lives with, subject to a Judge approving that it is in the child's best interest.
