Legal separation

A friend has separated from her husband, but still lives in their rental home, with their children, and is still somewhat dependent on him financially. His name is still on the lease, but he no longer lives here.

If she files for legal separation, are there legal means to guarantee that she will still receive financial assistance from him? How long does it take to set that in motion?

Also, if his name is on the lease, can she file a restraining order against him since he has moved (he continuously harasses her, in person and on the phone)? And if I live on the property but my name is not on the lease, can I file a restraining order against him?

She can file for legal separation. If the children are the husband's she can get child support from him. It will take a court order to getthe support begun unless he pays voluntarily.

She can seek a restraining order. has the hubsand been violent?

Suggest that third party stay out of it.
