Legal Question in Family Law in Georgia

Legal Separation

Me and my husband signed separation papers in August, and the papers still are not final. I was wondering if we were to have relations with each other does that make the papers void, and are we leagally married again at that point.

Re: Legal Separation

I am not sure what you mean by "separation papers" since in Georgia there really isn't such a thing. I am going to assume you mean divorce papers.

To obtain a divorce in Georgia you must remain separated (meaning no sexual relations) from PRIOR to the filing of the divorce until the date the judge signs a decree. Sex is considered a reconciliation, and terminates a divorce. It also may condone past fault grounds for a divorce.

This sounds like you are trying to do a divorce without a lawyer (not a good idea especially given your question).

Re: Legal Separation

Your relations could be construed as a reconciliation, which would terminate the divorce proceeding.
