Legal Question in Family Law in Georgia

How does legal separation work in GA? Can you be separated and leave in the same house? During a divorce, if there is a house, how is it decided who stays in the house?

There is no such thing as "legal separation" in Georgia. Georgia has divorce, and the rarely used separate maintenance. To file either, you must be in a bona fide state of separation, which means no sexual relations, but can involve the parties being in the same house. If a house needs to be divided and the parties don't agree on who lives there, owns it and pays for it, a court decides this. It is very important to have a lawyer to deal with this.
