I found out that I have a 9 year old daughter in 2001 and I went to the hospital and had a DNA and it come back 99.97% that she is mine, Her mother is married to aother man and he is on my daughter's birth cetificate and he is her Legal father, He does relize that I'am her biological father but he will not concent to letting me legitimate my child as the mother does, Is this Possibl for me to do would any judge grant me this since there is such an absent's. I have been in her life since I found out about her and we do have a great relationship building, I just want to continue to be in her life,

You should file a petition for legitimation, despite their consents. You should offer the DNA test as evidence establishing paternity. I can't tell you what the courts will do so I suggest you contact a local attorney for some guidance in the matter.
