If a mother consents to legitimation,and the child already has the mothers last name,does the child automatically get the fathers last name?

No, this is not automatic. It the mother does not consent to the name change, then the judge must decided if it would be in the child's best interest to change his/her name. Feel free to contact my office for further consultation on the matter.
