Legal Question in Family Law in Georgia
Ligitimizing child
My cousin has a child and is not married to the mother. Does he need to have the child ligitimized to have any legal rights to the child? If so how does he go about getting the child ligitimized? And about how much does this cost?
Thanks

Yes, your cousin does need to legitimze the child in order for the child to inherit from your cousin; and for your cousin to inherit from the child. Legitimation also will give your cousin legal rights to make important decisions in the child's life; right now, only the mother is the legal custodian of the child. These are just some of the situations that might affect the child and your cousin by legitimating the child. I charge $800.00 to do the legitimation; the average fees from other attorneys may vary. You can hire an attorney to do the legitimation or you can do it yourself. If you choose to do it yourself, attorneys and court personnel cannot advise you of the procedures to do one correctly because that would be assisting you to practice law without a license. You can visit public law libraries to find more information on legitimation, but if you choose to use any forms, you must know how to do the legitimation correctly yourself.

A legitimization is necessary to establish visitation and other issues, and also can set support. There are many pros (and cons) depending on the facts, and I'd suggest that the father give us a call if he's in the Atlanta area at 404-768-3509.
