Legal Question in Family Law in Georgia
I live in GA. I have custody of my two children, ages 13 and 17. The 17 yr old wants to go live with her father. She is in the 12th grade and will graduate May 2012. What are my rights? I don't want her to hate me, and I just don't know what to do. She says she wants to get to know her daddy (we have been divorced since 2001). If I let her go: 1. Do I have the right to make her come back home if I feel she is not progressing in school like she should? 2. Do I have the right to tell her she can only stay till the end of 2011? 3. Will this affect child support? 4. Will I still carry insurance on her? 5. Will she still be covered under my auto insurance? 5. Do I have the right to tell her she has to come back if I don't feel the home is stable? This is not a decision that will not be taken to court. Court is so expensive, as are lawyers. I can't afford either. Will letting her go voluntarily affect my rights?

The 17 year old has no legal say unless a court case is filed. You CANNOT change legal custody without a court case, and even if you let the child live with the father he must pay child support as per the court order. Neither you nor the father can legally defy the court order.
