Legal Question in Family Law in Georgia

I live in Ga. My husband owns business in Ky.- which I have helped him run for the past six years. He is now in jail for a forgery charge and has been on drugs. He has almost ruined this company financially- but w/ the help of his family we have managed to keep it running. My question is- If I divorce him do I legally own have of the company? He is the only one listed as owner. his is how I support my 2 children. It's a great business- but need to know if I should start doing something else. PLEASE HELP!!!

You can ask for his interest in the business in a divorce case. Unless he agrees with giving you his interest, a division of the business is up to the court. Georgia recognizes equitable division, meaning that a court would decide what percentage you were entitled to - that could be anything from 0% to 100%.
