Legal Question in Family Law in Georgia

I live in GA - my nephew has lived with me and my husband for over a year now and on and off before this started since he was born. He is 12 yrs old and enrolled and attending school where we live. I need to get guardianship over him legally in case I need to take care of an emergancy with him and to get insurance for him, but am afraid if I start the legal process she may come and get him and she is not fit to be a mother in my opinion. She brought him to me because she said she didn't want him and could not handle him. He is not a bad child just needed discipline. And he is doing so good here with us! Is there anything that can be done to keep her from taking him once I start the legal process? I live in Bartow County, Georgia. She (my ex sister-in-law) lives in Alabama.

Without going to court, she can get the child at any time, and without going to court, you are breaking the law in enrolling the child in school. Get a lawyer and seek proper paperwork.
