Legal Question in Family Law in Georgia
He I live in georgia, I have applied for a foster care /adoption license. I was denied because my husband had a DUI last yr. He has done all he needed to do, and is finished with probation. I have done alot of research on the law which states what the disqualifications are they are listed in GA ann code 49-5-69.1, 49-5-60: rules and regs 290-9-2-07. (Fed lay is pretty much the same) A DUI is not listed there yet i am being told that any recent criminal history is a disqualification. I have already appealed they said there is nothing they can do because of this and the law. The polocies for the state in their handbook just say a foster/adoptive home must meet minimum standards as ste by state and federal law. Can they still deny me? is there anything i can do, i cant get a straight answer from anyone at any state office and i have called many lawyers that just dont know. We have a great home, and there are so many kids that need one i just cant let this go.

Regardless of the answer, you need a lawyer who works in this area to assist you, and not a general information website. The question is not whether they can deny a license, as obviously they have done so. You can keep fledgling along and trying to do it yourself, which has not worked, or get a qualified lawyer.
DUI is a criminal case.
