Legal Question in Family Law in Georgia

I live in Georgia and my great aunt lives in N.J., I am moving her to live with me since she is up in age and has no other family. I would like to know if I need to file a durable effective immediately power of attorney form through the court in NJ or Georgia to handle all her financial and medical affairs? Or is it necessary to file with the court at all since she has no major assets? Please advise

Thanks,

First of all you can file or make one. Only she can. And if she's in NJ, you'd do one in New Jersey. And you do NOT use a form; you use a lawyer.

The fact that you asked about a POA for someone without assets shows you don't know what one does, and that's a big reason you need legal counsel. POA's deal with assets. No assets, no need.

Things that may be more important might be a health care directive, a conservatorship if her mental capacity is declining and a will. Discuss them all with NJ counsel.
