Legal Question in Family Law in Georgia

i have not been living with my husband for 3 years now and i have been filing single and we live in different states and i got this divorce kit and it is asking me to fill out husband or wife on this: We both agree that we will cooperate in the filing of any necessary tax returns. We also agree that any tax refunds for the current year will be the property of the ( husband/ or wife ) and that any taxes due for the current tax year will be paid by the ( husband/ or wife ). Can you help me with what i put down with the husband or wife part please?

First of all, shred the "divorce kit." It's garbage. You wasted money that should have been spent on a lawyer. The chances of doing a divorce right with a generic form are small, especially when you are in two different states.

It was NOT proper to file as single while you were married. When you get audited, you are going to have a problem.

So see a lawyer to get the divorce right and a CPA to amend your taxes.
