Can I make him leave?

My husband and I have been married for four years. We have two children. I want a divorce, but he will not leave our home. He does pay the mortgage, but only my name is on the mortgage. Considering that the house is in my name, can I make him leave and if so, how do I go about doing so?

Absent family violence it may be quite some time before a court addresses the issue. Your first step is to hire a lawyer to commence a divorce. Without a settlement, it may be an expensive and lengthy process.
