Legal Question in Family Law in Georgia

Marital Separation

My husband and I are unofficially separated, at his request, because I had a an affair. He has come to the house I am staying at and physically abused me - I have not escalated the situation legally. I went into our home yesterday to talk to him, and as a result, today he changed the locks. My question is - since we are not legally separated or divorced, and I do own half the house - is it legal for him to change the locks and not allow me access to our home?

Re: Marital Separation

Well, it may not technically be illegal for him to change the locks on a house that he is part owner. However, he hasn't done himself any favors in the legal sense by acting like a jerk. Judges generally don't like guys who act like this. You should consider a Petition for Separate Maintenance, which is what most people call a legal separation. If you would like to discuss this matter with me, feel free to call.

Re: Marital Separation

If he is physically abusive, you need to either call the police or seek a restraining order. Your best bet is to see a lawyer who can take immediate action, since it looks like you showing up may only escalate violence or other problems.
