marriage license not recorded

Before I remarry do I need to file for a divorce even if the marriage license was not recorded in 2001. I did not receive a certified copy o f the marriage license.There was a cermony but the certificate was not put into computer so there is no record of it. And I can not get in contact with the missing spouse. We have one child that was born a few months after the marriage but he has no custody and has paid no child support because I have not been able to locate.
