I married my husband 12/08 he cheated the next month. I decided not to change my name on anything. Now I want to file for Child Support. Can I get in trouble for not changing my name? Can I still file for Child Support.

You will not get in trouble for not changing your name and you can still seek child support.
Child support is not dependent on your name. Ultimately you can fix the name situation in a divorce.
You don't have to change your name once you get a divorce. In fact, many women with children do not change their names after the divorce. The only way this would be mandatory is if the divorce decree required you to do so.
In any event, even if the court required you to change your name, you are not prohibited from seeking child support. You may want to consult with local counsel to represent you in this matter.
