i'm married and my 7 year old wants her name changed. The biological father has not paid child support in 5 years and he has been in and out of prison for the last 5 years. I am the custodial parent and we were never married. I am married now and daughter wants our last name but I know he will oppose is there anyway we can have it done without his permission

A name change is done in court. Under the facts as posted, if the father does not consent, it is up to the court whether to grant it, but yes, a court can grant it over his objection. I'd suggest retaining counsel so you get it right.
