Legal Question in Family Law in Georgia

I am about to marry my sons father, but at the time of birth he did not sign birth certicate, so his last name is mines, if we marry will he still have to letitimize his son, or can we do a name change

You may be okay with just a name change, but I'd recommend an extra step. The birth certificate can be amended through a court case without a legitimization, and my office has experience with such cases.
