Mediation No Show

A friend is going through a nasty divorce. They finally have mediation scheduled. Her husband has asked her several times to reschedule mediation, but she does not want to nor can she because of her work schedule. Now he is threatening to not show up. What happens if he does not show up? Is this considered the same as not showing up in court? Does she have to reschedule? Does it just go to a judge at that point?

Work is not an excuse to miss mediation, and court annexed mediation is court.

What happens is up to the court. His answer can be stricken. He can be ordered to pay the mediator and to pay other costs. He can anger the judge and harm his case. He can be jailed for contempt.

In most cases, the court would reset the mediation once and probably make him pay attorneys fees and pay the mediator. But it's up to teh court and she should discuss this with her lawyer.

If the mediation is court-ordered, a judge can order him to attend or be held in contempt. If the mediation is voluntary, it is just that: voluntary.
