Medical, Dental, Vision Insurance Premiums

The Medical Insurance portion of our final agreement from a 2002 divorce states: ''The parties agree to divide equally all of the medical, mental, dental, optical and RX drug expenses for the minor children of the parties not covered by any availalbe medical insurance policy.'' My ex is currently carrying the insurance on our daughter thru his company and making payroll deductions for the premiums - does this particular statement include that I am to pay 50% of the payroll deductions? I am understanding this only means pay 50% of all out of pocket co-pays, glasses, RX co-pays, deductibles, etc. Can you help? Thanks.

Have an attorney review the entire agreement. If no mention is made about your responsibility for payment of the premium, then you probably have no liability for that. However, if what you state is true, it raises the troubling question as to whether your ex is required to maintain the insurance.

We'd have to read the entire agreement to answer you as it is possible other language in the agreement will affect the answer (in fact that is likely). Call the lawyer who represented you. He'll have a copy and can fully answer you.
